This agreement applies between the customer and Design Saga (reg. Sacred Monkey org. No. SE940505663201 – hereafter, referred to as Design Saga, us, we, our or our website as required). The agreement applies to all services and products Design Saga offers (hereinafter referred to as the products).
Before you use our Websites and Services, you must ensure that such use is in compliance with all laws, rules and regulations applicable to you. Your right to access the Websites and Services is revoked to the extent your use thereof is prohibited or to the extent our provision thereof conflicts with any applicable law, rule or regulation. You are responsible for making these determinations before using the Websites and Services.
The Websites and Services are not targeted towards, nor intended for use by, anyone under the age of 18. By using the Websites and Services, you represent and warrant to us that: (a) you are 18 years of age or older; or (b) you otherwise have sufficient legal consent, permission and capacity to use the Websites and Services in applicable jurisdiction(s) as determined by you.
We may, in our sole discretion, refuse to provide or continue providing the Websites and Services to any person or entity and change eligibility criteria at any time, including if you fail to comply with the TOS. We reserve the right to deactivate, terminate, prevent access to, disable services for, and/or delete any Accounts or access to the Websites and Services at any time at our sole discretion.
The agreement includes contract period, fees and termination, support and maintenance, disclaimer, customer liability, personal data and other contract terms.
1.2 Amendments to the agreement
Design Saga reserves the right to change this agreement at any time. The new agreement is valid as it is published on our website.
2. Contract period, fees and termination
2.1 Payment of fees
Our fees for subscription are payed in advance. We use stripe (https://stripe.com) as a payment handler (hereafter referred to as the payment handler) for all types of fees. The processing of payments may be subject to the terms, conditions and policies of the payment handler in addition to this TOS. We are not responsible for acts or omissions of the payment handler. You agree to pay us, through the payment handler or as otherwise agreed to by Design Saga, all sums for Services you select or use at applicable prices in accordance with our pricing and billing policies and you hereby authorize us and applicable payment handler to charge all such sums (including all applicable taxes) to the payment method(s) specified in or linked to your account.
You must provide current, complete and accurate information for your Account and Billing Information, and must promptly update all such information in the event of changes (such as a change in billing address, credit card number, or credit card expiration date). You must promptly notify us or our Payment Processors if your payment method is canceled (e.g., for loss or theft) or otherwise inoperable. Changes to such information can be made in your account.
2.2 Contract Periods and Data information
The contract period is specified on the order. For all subscriptions that are over one month in length, we will send out a reminder that the subscription will expire shortly before the expiration date. The customer can then renew their accounts in case of expiry from their account page.
The customer has the right to terminate their subscription at any time. Invoices that have already been paid shall not be reimbursed even if some time exists on the subscription.
Upon termination of the subscription, all data stored at Design Saga will be deleted. Backups, if available and requested, can be restored within 7 days from site deletion.
2.3 Fee changes
Fee changes will be informed on our website. We retain the rights to charge a changed fee when renewing a subscription.
3. Support and Maintenance
Design Saga takes no responsibility for any damage that a customer, directly or indirectly, suffers through the use of the subscription. This includes, but is not limited to; server crash, malfunctioning backup system, system downtime, loss of data and/or advice resulting in loss of data. The customer can not claim any compensation for damage caused to their data. That being said, if the customer has requested data backups, Design Saga will keep regular backups of the site as requested. We take care to make sure your data is kept private and handled in terms stated by the Swedish Personal Data Act (1998:204) and the General Data Protection Regulation.
3. Third Party Applications
Any third party plugins, CRM, or other software (hereafter referred to as software) provided by Design Saga is subject to said software’s terms of service as well as our own. Design Saga takes no responsibility for third party software.
